IMD - Institute for Management Development ("IMD") is providing you access to this Circulatory Scan application and services contained therein (collectively, the "App"). The App may be accessed by you through the internet via your browser or application (mobile or otherwise).
Your use of the App is subject to all terms and policies as posted from time-to-time including the IMD Privacy Policy; (collectively referred to as the "Terms").
Acceptance of the Terms
By accessing or using the App, you acknowledge and represent that you have read, understood, agree to be bound by, and accept these Terms. IF YOU DO NOT AGREE TO THESE TERMS, PLEASE DO NOT USE THE APP.
IMD may, at any time and at its sole discretion, modify these Terms. Any such modifications will be made available online and will be effective immediately upon posting to the App. You agree to assume responsibility for periodically reviewing these Terms. By continuing to use the App, following the initial posting date of modifications made by IMD, you agree to be bound by the Terms as amended.
Description of Service
The App provides a series of multiple-choice questions designed to assess the readiness of your organization to develop and adopt circular economy business models, while also providing educational materials about each area being assessed. It is a free, educational tool and does not require personal data processing to use.
Right to Use the App
As long as you comply with these Terms, IMD grants you a personal, non-exclusive, non-transferable, limited permission to enter and use the App. Any unauthorized use of the App terminates the permission granted by IMD to enter and use the App. No person under the age of 18 may be use the App.
Ownership and Use of Materials
All information, data, text, communications, graphics, user interfaces, visual interfaces, photographs, trademarks, logos, sounds, music, artwork and computer code contained in the App (collectively, "Materials") are owned, controlled or licensed by or to IMD, and are protected by copyright, patent, trade dress and trademark laws. You may download, print, and view Materials from the App under these Terms as long as you use the Materials only for non-commercial, personal use and you do not modify or alter the Materials in any way. You may not copy, republish, distribute, prepare derivative works, modify, or otherwise use the Materials other than as expressly permitted by these Terms. IMD reserves the right to revoke at any time the authorization to view, download and print the Materials available on or via the App, and you must discontinue such use immediately upon notice from IMD.
Right to Charge
The App is currently free, IMD reserves the right to charge a fee for use of the App in the future.
User Obligations
You agree to use the App only for lawful purposes and in a way that does not infringe the rights of, restrict, or inhibit anyone else's use and enjoyment of the App.
Disclaimer of Warranties
The App is provided "as is" and "as available" without any representations or warranties, express or implied. IMD does not warrant that:
- The App will be constantly available, or available at all; or
- The information on the App is complete, true, accurate, or non-misleading.
Privacy
Please review our Privacy Policy (https://www.imd.org/settings/privacy/) on the processing of personal data of all users.
Limitation of Liability
IMD will not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages resulting from your use of the App.
Governing Law
These Terms will be governed by and construed in accordance with the laws of Switzerland, without giving effect to any principles of conflicts of law.
